Brand safety with generative AI: what enterprise teams actually need

The brand-safety conversation about AI usually stops at 'be careful'. Here is the concrete checklist enterprise teams use to say yes: rights, retention, brand controls, approvals and an audit trail.

Most brand-safety conversations about generative AI end with someone saying "we just have to be careful", which is another way of saying nobody knows what the controls should be. After sitting in many of those meetings, here is the checklist that actually gets a legal team to yes.

Rights you can show, not assume

The first question is always the same: can we publish this commercially? The answer has to be structural. Work only with models whose training and output terms permit commercial use, keep the rights position per model documented, and be able to show which model made which asset. If a tool cannot tell you that, the honest answer to legal is "we do not know", and the project dies there — usually correctly.

Retention is a contract, not a setting

Whatever touches a third-party model must do so under zero-retention terms: nothing stored, nothing trained on. That is a clause in an agreement, not a toggle in a UI. And for the work that must never leave the building — unreleased products, unannounced campaigns — the only real control is a model running inside your own perimeter.

Brand control at generation, not in review

The expensive way to be on brand is to generate freely and fix it in review. The controlled way is a brand hub the system consults before anything is made: palette, typography, composition rules, tone of voice, approved claims, banned words. When the rules are applied at generation time, review stops being a filter for disasters and becomes what it should be: judgement about good work.

Approvals with an audit trail

Nothing ships without the sign-off chain the organisation already trusts — and every generation, edit and approval leaves a record. The audit trail is not bureaucracy; it is what turns "we think this is fine" into "here is who approved what, when, based on which rules".

The question that summarises all of it

If a regulator, a rights holder or your own board asked tomorrow how a specific asset came to exist, could you answer in five minutes with documents rather than memories? Teams that can say yes ship AI content at volume with remarkable calm. Teams that cannot are one incident away from a policy that bans everything.

Careful is not a control. Controls are controls.
