The EU AI Act's transparency duties for realistic synthetic content apply from August 2026, and other regions set their own rules.

What is AI content creation?
It is the production of marketing and communication content, such as images, video, audio and text, using generative AI models directed by people. In a brand context it also covers the controls around generation: brand rules, product accuracy, rights, approvals and disclosure.
Is AI-generated content allowed in advertising?
Generally yes, under the same rules as any advertising: it must not mislead. Some places add specific duties. The EU AI Act requires disclosure of realistic synthetic content from August 2026, China has required labels on AI-generated content since September 2025, and France requires influencers to mark AI-generated images.
Who owns AI-generated content?
It depends on the country and on how much human creativity shaped the result. The US Copyright Office requires human authorship for protection. UK law still protects computer-generated works under a specific provision, though the government proposed removing it in 2026. Brands protect their position through human-led direction, clear platform terms and records of how each asset was made.
